Shawn Fabian is a seasoned litigator and counselor who represents management-side clients nationwide in bet-the-company employment and business-to-business disputes, including high-profile whistleblower, harassment, restrictive covenant and trade secret matters. Shawn also advises the firm’s corporate partners on employment matters related to mergers and acquisitions, and he regularly conducts workplace investigations involving code of conduct, fraud, discrimination, harassment and retaliation allegations. Shawn’s clients range from multinational Fortune 100 companies to small employers around the country.
Litigation
In his litigation practice, Shawn represents domestic and international clients in federal and state courts, before administrative agencies and in arbitrations. He has deep experience prosecuting and defending complex matters involving restrictive covenants, trade secret misappropriation and high-profile sexual harassment, whistleblower retaliation, discrimination and class action wage-and-hour matters.
Counseling and Internal Investigations
Shawn counsels on diverse workplace issues, from preparing personnel policies to navigating large-scale reductions in force and executive separations. He regularly conducts sensitive, complex workplace investigations and audits, particularly within the aerospace, defense and healthcare industries. His investigations often involve alleged wrongdoing by C-suite executives.
Mergers and Acquisitions
Shawn partners closely with the firm's Corporate practice on mergers and acquisitions, drawing on years of experience with both buy-side and sell-side deals. In fast-moving deal environments, he delivers practical, business-oriented employment solutions and structures sophisticated agreements tailored to the needs of each transaction.
Shawn joined Sheppard after serving as Chief Counsel for Labor and Employee Relations at a nationally recognized hospital in New York City. Previously, he served on the legislative staff for a U.S. senator and a U.S. congressman on Capitol Hill.
