Overview

Wynter Deagle is a seasoned trial lawyer who defends companies in high-stakes individual actions, class actions, mass arbitrations and government investigations involving privacy, cybersecurity and consumer protection. She is a trusted advisor to clients navigating litigation and compliance challenges tied to data breaches, AI, digital advertising and data collection use and monetization.

Known for her sharp legal insight, practicality and business-focused counsel, Wynter blends boardroom strategy with courtroom tenacity. Wynter has successfully defended claims under a wide range of state and federal laws, including the California Consumer Privacy Act (CCPA), Confidentiality of Medical Information Act (CMIA), Telephone Consumer Protection Act (TCPA), Washington’s Commercial Electronic Mail Act (CEMA), California Invasion of Privacy Act (CIPA), California Anti-Spam Law and the Electronic Communications Privacy Act (ECPA), among others.

Her litigation experience spans cutting-edge issues such as AI deployment, data monetization and the use of tracking technologies like cookies and pixels. Wynter also represents clients in investigations and enforcement actions brought by federal and state regulators following privacy or cybersecurity incidents.

Beyond litigation, Wynter helps clients build and implement privacy and cybersecurity programs that meet legal obligations while still supporting business goals. Her counseling includes:

  • Compliance with U.S. and international privacy laws (e.g., CCPA, GDPR, BIPA, and COPPA)
  • Risk mitigation strategies for AI, digital marketing and data use
  • Incident response planning and breach management

Experience

Representative Matters

  • Representing nationwide health plan and hospital group in putative class action in California federal court alleging violations of Electronic Communications Privacy Act, California Information Privacy Act, Washington Privacy Act, Washington Healthcare Information Act, invasion of privacy, violation of the California constitutional right to privacy, breach of contract, and breach of implied contract arising out of use of session replay and website tracking technologies.
  • Representing insurance company in putative class action in California federal court alleging violations of California Information Privacy Act, invasion of privacy, and breach of implied contract arising out of use of chatbot technology.
  • Representing numerous companies in the retail, consumer products and technology industries in arbitrations alleging violations of California Information Privacy Act, invasion of privacy, and breach of implied contract arising out of use of chatbot technology.
  • Assisted publicly traded company to build and implement a global privacy and cybersecurity compliance program.
  • Obtained dismissal of a putative nationwide class action against an e-commerce company arising out of a data security incident. Simultaneously resolved a state attorney general investigation into the company’s data management and security practices with no adverse action being taken against the company.
  • Defeated a class certification motion in a putative class action in California federal court alleging an event management company’s website disclosures and data collection practices violated the Consumer Legal Remedies Act, False Advertising Law and Unfair Competition Law.
  • Guided a managed IT services company through responding to a data security incident that resulted in a successful malware infection and ransomware attack against nearly all of its customers. Also successfully resolved third-party claims for indemnification from customers impacted by the incident.
  • Defended a registration and event management company in a putative class action in California state and federal courts alleging website disclosures and data collection practices violated the California Consumers Legal Remedies Act and Unfair Competition Law.
  • Assisted clients in a number of industries in developing email marketing campaigns, text message campaigns, pre-recorded call campaigns, and online information collection programs in compliance with CAN-SPAM and COPPA, among other laws.
  • Obtained terminating sanctions and nearly $4 million in monetary sanctions on behalf of CrossFit, Inc. in federal court trade libel, deceptive advertising, and unfair competition litigation against its direct competitor, the National Strength and Conditioning Association.
  • Represented Shari Redstone in highly contentious litigation in Delaware and Massachusetts concerning the corporate governance of Viacom, Inc., including the proper composition of the Viacom board. The settlement was hailed in the press as a complete victory for Shari Redstone and her father, Sumner Redstone.   • Represented the board of directors of a broker-dealer in an internal investigation that resulted in discovery of multimillion-dollar fraud by senior executives. Secured seven-figure restitution award from perpetrators while ensuring that the client incurred no penalties or sanctions from regulatory authorities.
