Stephen Korniczky

Overview

Stephen Korniczky is an experienced trial lawyer who has spent over 35 years litigating patent, trade secret, trademark and other intellectual property cases. He is recognized internationally as an authority on standard essential patents (SEPs) and worldwide FRAND license obligations.

With extensive experience representing some of the world’s largest technology companies, Stephen has tried and argued cases in district courts throughout the U.S., before the Patent Trial and Appeal Board, the International Trade Commission (ITC) and on appeal to the U.S. Court of Appeals for the Federal Circuit.

Stephen was lead counsel for TCL Communication Technology Holdings in what is now known as the largest SEP case ever tried in the United States and the first to value an SEP portfolio containing thousands of patents. His work was recognized by the National Law Journal in its “Masters of the Courtroom” special report and the case was named a "Milestone Case of the Year" by Managing Intellectual Property magazine.

Litigating SEP and other patent cases on behalf of internationally based, publicly traded and emerging companies in many diverse technologies, Stephen has experience handling disputes involving wireless and cellular communications, video and audio compression, multimedia messaging service (MMS), Android operating system (OS), internet systems, software applications, liquid crystal displays (LCD), televisions, IC devices and semiconductor processes, artificial intelligence and fuzzy logic systems, automotive technologies and medical devices.

In addition to litigation, Stephen is particularly experienced in prosecuting patent applications and handling reexamination and inter partes review (IPR) petitions and has been ranked as one of the top two IPR attorneys in the country.

Utilizing his combined prosecution and litigation background to provide strategic counseling to clients, he advises on SEP and other business-oriented IP licensing and portfolio development plans. He has successfully designed and implemented value-added strategies to raise venture capital, generate licensing revenue, cross-license competing IP and position companies for acquisition.

Stephen is a former collegiate champion in judo and wrestling and has earned advanced blackbelt degrees in judo and jujitsu. Today he enjoys watching those sports and spending time with his wife and son and their two rescue Jack Russell terriers.
