Jonathan Clark

Overview

Jonathan Clark is an aggressive, strategic litigator who helps clients navigate the full life cycle of the employment relationship, with particular focus on “employee departure” litigation. He frequently represents companies seeking to enforce or defend against restrictive covenants, protect trade secrets, guard prized customer relationships and minimize risks when hiring or terminating key personnel.

Much of Jonathan’s practice involves emergency injunction actions in state and federal court to halt contractual and legal violations before damage occurs. He also guides companies through the dangers associated with hiring talent bound by overbroad or unenforceable restraints and regularly defends clients facing “rights and responsibilities” litigation filed by current or former employees—including single-plaintiff and class action claims of discrimination, harassment, retaliation and wage-and-hour violations. Jonathan is skilled at securing crucial discovery and deposition testimony that positions cases for favorable outcomes.

With an eye toward preventing litigation and mitigating risk, Jonathan helps businesses draft clear employment agreements, structure enforceable restrictive covenants and implement vital workplace policies and procedures. He also frequently oversees highly sensitive internal investigations.

Beyond employment law, Jonathan is well-versed in all aspects of general commercial litigation, advising clients on enforcing contracts, safeguarding confidential business information and trade secrets, enforcing fiduciary obligations and minimizing liability throughout every phase of a dispute.

Experience
  • Gregory Grim v. Confluent Medical Technologies, Inc. (W.D. Tex. Dec. 29, 2025): Obtained summary judgment for Confluent Medical Technologies against claims of disability discrimination and retaliation.
  • Defeated attempt by competitor to secure Temporary Restraining Order that would have prohibited client from servicing customers and recruiting personnel in the medical device industry, in the Circuit Court for Williamson County, Tennessee.
  • Defeated attempt by competitor of client in medical device manufacturing industry to obtain Preliminary Injunction that would have prohibited client’s new employee from working in key role.
  • Key member of litigation and trial team representing large home health and hospice enterprise in massive franchise dispute with franchisor. A four-week bench trial resulted in complete victory for client. Handled cross examinations, opening and closing statements, and numerous pretrial depositions and motion practice.
  • Obtained highly favorable settlement for multinational third-party logistics client that included entry of Agreed Permanent Injunction against former agent based upon claims of breach of restrictive covenant agreement and misappropriation of confidential information and trade secrets in the United States District Court for the Northern District of Mississippi.
  • MODE Transportation, LLC v. William Boyer et al. (D.C. Dallas, Jan. 11, 2022). Obtained Temporary Restraining Order against former agent based on allegations of breach of contract and misappropriation of confidential information and trade secrets.
  • TTS, LLC v. Positive Transportation, LLC (D.C. Dallas, Aug. 26, 2022): Secured Temporary Restraining Order and Temporary Injunction on behalf of multinational third-party logistics company against former agents based on claims of breach of restrictive covenants and misappropriation of confidential information and trade secrets
  • Josephine Robair v. CHI St. Luke’s (S.D. Tex., June 12, 2017): Obtained summary judgment for St. Luke’s against claims of racial discrimination in hiring.
