Heather Plocky represents clients in commercial and business litigation in both state and federal court. Her practice focuses on defense of Sarbanes-Oxley whistleblower retaliation claims, financial services litigation, complex e-discovery matters, real estate litigation and other complex commercial disputes.
Defending employers and officers in whistleblower administrative actions, civil lawsuits and regulatory inquiries—under Sarbanes-Oxley, Dodd-Frank and other federal and state whistleblower laws—Heather prepares and executes a cohesive strategy to safeguard clients and their proprietary and privileged information throughout the administrative, civil and regulatory process. To minimize clients’ risk and prevent disputes before they arise, she advises on whistleblower-related risks and conducts in-house compliance reviews to train employers. She also conducts internal whistleblower investigations.
In the arena of financial services litigation, Heather has extensive experience advising banks with assets up to $25 billion on complex disputes involving deposits, loans, regulatory requirements, internal controls and other matters.
Advising on e-discovery in bet-the-company litigation, Heather leads teams of up to 40 lawyers handling the collection, review, redaction and production of documents, including working directly with directors and officers.
Heather also counsels clients in real estate disputes, including matters involving commercial leases and purchase and sale agreements, leveraging her experience to strategically resolve controversies.
Heather is a member of the firm’s Securities Enforcement and Litigation team, serves as co-chair of the firm’s Los Angeles Recruiting Committee and is a member of the firm’s Women Lawyers Group National Leadership Council.
In her free time, she enjoys Dodgers baseball, hockey and fantasy football.
