Matt Tharp is an associate in the Business Trial Practice Group, based in New York.

Matt’s practice focuses on representing corporations and their executives in complex commercial disputes, including actions involving claims of breach of contract or securities fraud.

Represented global asset management firm in federal employment discrimination action in the Southern District of New York. Obtained summary judgment dismissal of all claims by the District Court and affirmance by the Second Circuit.
Represented an ad hoc group of term lenders in litigation before the U.S. Bankruptcy Court for the Southern District of Texas challenging the validity of a first-of-its-kind liability management exercise.
Represented global pharmaceutical company and its subsidiary in breach-of-contract litigation in the Delaware Court of Chancery arising out of the client’s purported failure to make hundreds of millions of dollars in earn-out payments. After a bench trial, the court entered a complete defense verdict in client’s favor.
Represented private investment firm in nine-figure dispute brought by a terminated former partner alleging more than a dozen contractual and equitable claims. The arbitration panel denied all of the former partner’s claims for damages and found that he was in breach and had to return millions in escrowed severance.
Represented private equity firm and its portfolio company in putative securities class action in the Commercial Division of New York State Supreme Court. Obtained dismissal of all claims with prejudice.
Represented Chinese manufacturing company and certain of its executives and officers in putative securities class action in the Southern District of New York. Obtained dismissal of all claims with prejudice.
