Mark Rackers is an experienced litigator and trial lawyer who defends companies in complex commercial litigation. A co-leader of the firm’s Multifamily Housing team, his focus is on defending landlords and property managers in class actions.
Mark is recognized for his meticulous attention to detail, responsiveness, and unwavering commitment to defending his clients' interests. With a wealth of experience in the rental housing sector, he handles disputes involving contracts, consumer protection statutes, and claims associated with security deposits, late fees, “junk fees,” application fees, habitability, credit reporting and rent increases. Additionally, Mark provides valuable guidance to landlords and property managers on regulatory compliance.
Beyond his real estate litigation practice, Mark has experience handling business disputes in the healthcare and financial services industries, including consumer lending disputes and unfair competition and false advertising claims.
In addition to serving as lead trial counsel, he has successfully argued before the Ninth Circuit, California Supreme Court, and several California Courts of Appeal.
Mark serves on the firm’s pro bono committee and heads pro bono efforts for the San Diego office.
In his free time, Mark enjoys spending time outdoors with his wife and kids and their chocolate lab, as well as playing in a dad-rock band.
