Lu Ling focuses his practice on intellectual property, with an emphasis on patent litigation. He has represented both plaintiffs and defendants across numerous litigations before the federal district courts, Patent Trial and Appeal Board (PTAB), and the International Trade Commission (ITC). With his broad technical background and education, Lu is able to grasp and handle cases involving a wide range of technologies. His past cases have involved wireless communications, semiconductors, video codecs, medical devices, life sciences, oil and gas, automotive technologies, and numerous other fields, both broad and niche.
Prior to entering private practice, Lu served as a judicial clerk for the PTAB at the U.S. Patent and Trademark office, granting him particular expertise in post-grant proceedings. He has since successfully represented his clients—both petitioners and patent owners—in a multitude of different inter partes reviews (IPRs) and drafted numerous petitions, patent owner responses, and other briefs and motions. His deep understanding of IPR procedural and substantive requirements has also allowed him to devise unique solutions for balancing arguments in parallel litigations between the PTAB and other forums.
Beyond litigation, Lu's experience also includes drafting and prosecuting patent applications, as well as conducting patent portfolio due diligence and management. He regularly drafts opinions on patentability, infringement, and freedom-to-operate. In addition, Lu also provides counsel on other forms of intellectual property, including copyrights and trade secrets.
