Gregory Hurley

Overview

Greg Hurley is a nationally recognized trial and appellate lawyer focused on disability access and discrimination law.

A member of the Attorney Settlement Officer Panel for the U.S. District Court for the Central District of California since 2003, he brings more than 35 years of experience advising courts, public entities and private businesses on compliance and litigation strategy under the Fair Housing Act and the Americans with Disabilities Act. He represents national multi-family and single-family rental operators (SFRs) on FHA issues related to Section 8 and discrimination claims.

Greg has led the trial defense of numerous statewide and national class actions involving discrimination and access claims, including the largest class action ever certified against the State of California. His experience spans matters brought by both private plaintiffs and the U.S. Department of Justice, and he has successfully defended class actions in industries including retail, hospitality, food service and entertainment. In 2012, he secured decertification of a major damage class action involving hundreds of restaurant locations.

Shaping precedent has been central to Greg’s appellate work. Through landmark Ninth Circuit rulings—Lonberg v. Sanborn Theaters, Oliver v. Ralphs Grocery Store and Lonberg v. City of Riverside—and briefs before the U.S. Supreme Court, he has advanced the defense perspective on access law for the National Association of Theater Owners, the California and National Restaurant Associations, the National League of Cities and more than 200 California cities.

An authority on disability law, Greg is the author of Defending Disabled Access Claims (Wiley Law Publications). He advised the California Legislature on SB 1186, revising state discrimination statutes, and frequently speaks at national conferences on access litigation and compliance. He is a member of the National Rental Home Council’s Legal Advisory Board.

  • State of California (Caltrans) — Defended the State in the largest class action ever certified against it, involving more than 10 million claimants and 4,000 miles of pedestrian routes and 90 Park & Ride facilities.
  • Los Angeles Superior Court System — Defended against a statewide class action brought by the ACLU.
  • Starbucks, In-N-Out Burgers, Kroger / Ralphs Grocery Stores, The Irvine Company, Home Depot, Adidas, Auto Club of Southern California — Served as lead trial counsel in statewide and national class actions alleging access discrimination.
  • Taco Bell Corporation — Achieved decertification of a damages class action involving more than 200 restaurant locations.
  • United States Department of Justice v. AMC Theaters — Defended a national class action brought by the U.S. DOJ.
  • Marriott International — Defended a national class action involving 80 golf course properties.
  • Lonberg v. Sanborn Theaters; Oliver v. Ralphs Grocery Store; Lonberg v. City of Riverside — Argued and won landmark Ninth Circuit appellate cases defining key standards under the ADA.
  • National Association of Theater Owners; California and National Restaurant Associations; National League of Cities; coalition of 200 California cities — Authored briefs before the U.S. Supreme Court and the Ninth Circuit advancing the defense position on accessibility law.
  • California Legislature (SB 1186 Committee) — Advised on revisions to state discrimination statutes and accessibility legislation.
